The General Terms and Conditions of the online shop www.postanipartizan.com have been drawn up in accordance with the Consumer Protection Act (ZVPot) and on the basis of the recommendations of the Slovenian Chamber of Commerce and Industry and international codes for online and electronic commerce.

The General Terms and Conditions of Business govern the manner of operation of the online shop www.postanipartizan.com (hereinafter referred to as the “Postani Partisan online shop”), which is operated by Larso, s.p., Avgustinčičeva 37, 1000 Ljubljana (hereinafter referred to as the “Provider”), the rights and obligations of the Provider and the visitors of the www.postanipartizan.com website and the users who make a purchase through the www.postanipartizan.com website (hereinafter referred to as the “Buyer”).

The Provider undertakes to make the following information available to the Buyer at all times:

the identity of the tenderer (name and registered office of the company, registration number),

contact details enabling the user or the purchaser to communicate with the provider,

the essential characteristics of the goods, the conditions, costs and possible methods of delivery of the goods, the prices clearly and unambiguously set out and a clear indication of whether they already include taxes and delivery charges,

the possible methods of payment, the validity of the offer in time and the conditions and time limits for withdrawal from the contract,

an explanation of the complaints procedure, including full details of the contact person or customer service.

Order, order acknowledgement, order verification and order confirmation

Upon receipt of an order sent by the Customer, the Provider shall immediately confirm acceptance of the order to the Customer. This is confirmation that the order has been accepted by the supplier and that dispatch of the goods will commence. The contract of sale between the supplier and the buyer is concluded at the moment when the supplier sends the confirmation of the order by the buyer via the internet.

Price

All prices on the website are in euros and do not include VAT. A reduced price is a reduced regular price at which the featured product is sold for a fixed or indefinite period of time.

All prices in the online shop are the prices of the products and do not include delivery charges. All prices are valid only for electronic ordering of products via the online shop. Prices are valid at the time of placing the order and have no predefined validity. Prices are valid in case of payment by the published payment options. Product images are for illustrative purposes only and do not necessarily reflect the full actual state of the offer.

Due to the nature of doing business on the World Wide Web, the offer of the Postani Partisan online shop changes and is updated quickly and frequently. Despite our best efforts to provide the most up-to-date and accurate supplier information on the Postani partizan online shop, it is possible that price or delivery information may be incorrect. In this case, or in the event that the price or delivery status changes during the processing of the order itself, the supplier will allow the customer to withdraw from the purchase or offer the best possible solution to the mutual satisfaction of both parties.

Consumer protection

Larso, s.p. sells goods through the website www.postanipartizan.com exclusively to consumers. Due to the specific and limited nature of the goods, the customer may order up to a maximum of 15 pieces of the same product in a single order.

Payment method, delivery and delivery charges

Payment for goods purchased from www.postanipartizan.com can be made by cash on delivery (in Slovenia), through the PayPal secure payment system or with a supported credit card through Stripe.

All products are delivered to the customer in Slovenia by the contractual partner DPD Slovenia (hereinafter referred to as the “delivery partner”) to the customer’s address in Slovenia, which is specified in the order.For delivery to EU countries DPD, GLS and POŠTA SLOVENIJE, for other countries, GLS, DHL and POŠTA SLOVENIJE.

The delivery price for Slovenia is 4 € per order. The delivery price for abroad depends on the country where the product is being shipped.

The delivery time for ordered goods is 3-5 working days for delivery in Slovenia. If the goods are not in stock, the supplier shall inform the buyer and agree with the buyer on the delivery time.

In cases where the supplier dispatches the ordered products on time and in accordance with the contract, the supplier shall not be held liable for the delivery time exceeded by the contractual delivery contractor.

Delivery of the goods

In the case of delivery by a delivery service of DPD, GLS, DHL or POŠTA SLOVENIJE, the addressee shall be obliged to collect the goods from the courier at the address chosen by the addressee during the purchase process, under the conditions set out by DPD, GLS, DHL or POŠTA SLOVENIJE..

The buyer or the addressee is obliged to check the quantity and quality of the goods upon receipt.

The Buyer expressly undertakes that, due to the delayed delivery of the goods or a different method of delivery of the goods, he waives other means of recovering the costs incurred, the purchase price paid and the delivery costs paid, such as, for example, claims for damages in the form of civil actions and the like, but he retains all other minimum rights in accordance with the provisions of Articles 23 and 24 of the Consumer Protection Act.The Buyer shall not be liable for any damages or other claims for damages. We will dispatch all products in stock within 3-5 working days of receipt of your order. We do not dispatch goods on Saturdays, Sundays or public holidays.

Withdrawal from an order

After placing an electronic order, the Customer may withdraw from the order within 24 hours by sending a withdrawal notice to [email protected].

In accordance with the Consumer Protection Act (ZVPot), you may return ordered goods purchased under a distance contract (which includes purchases made via the Internet) without reason. The right of withdrawal is exercised by the buyer by notifying the provider in writing at [email protected] within 14 days of receipt of the goods that he/she is withdrawing from the contract, without being required to give a reason for his/her decision. The communication shall be deemed to be timely if it is submitted within the time limit. The Buyer must return the goods packaged, in unchanged quantity and undamaged and unused to Larso, s.p. at the address Avgustinčičeva 37, 1000 Ljubljana. The costs of returning the goods shall be paid by the Buyer and the purchase price shall be refunded within 14 days of the withdrawal notice. We do not accept redemption shipments.

Refund of the purchase price

If you cancel your order, we will refund all payments made in accordance with the law, once we have received the goods and found them to be undamaged, in unchanged quantity and unused. The costs of returning the goods in the event of withdrawal from the order shall be borne by the buyer. We shall refund the purchase price within 14 days of receipt of the cancellation notice and the return of the goods. When returning the goods, the buyer shall also send the invoice for the goods and personal details and a transaction account to which he wishes the payment to be returned.

Rejection of the order

The online shop www.postanipartizan.com may refuse an order for which it finds that it is not possible to carry out the order under the conditions and with the information at its disposal.

Storage of the order

The electronic order or purchase contract is stored at the registered office of the company. At the consumer’s request, a copy of the order shall be sent to the e-mail address or physical address indicated in the order. The request may be made to our e-mail address [email protected] or in writing to the registered office of the company.

Complaint

At Larso,s.p. we are committed to quality products. If you have received a product that does not meet your requirements, we will replace it with another one or refund the purchase price if you wish. You can return it undamaged, unused and in its original packaging within 14 days of purchase to Larso, s.p., Avgustinčičeva 37, 1000 Ljubljana and we will refund your purchase price within 14 days. The return option does not apply if the product has been used. We do not accept redemption shipments.

Returns of damaged items

In the event that the postal package with which the customer received the products ordered is physically damaged, missing contents or shows signs of opening, the customer must initiate the complaint procedure with Larso,s.p. This should be done by sending a picture of the damaged package and/or products to [email protected], attaching a copy of the invoice and the online order number. Together with all delivery services, we will make sure that the complaint is resolved as soon as possible.

The costs of sending the complaint shall be borne by the Supplier via the delivery services.

Guarantee claims in case of non-conformity of goods

The consumer may exercise his/her rights due to the non-conformity of the goods insofar as he/she has notified Larso, s.p., under the following conditions and in the following order:

request the restoration of conformity of the goods (repair or replacement) free of charge;

request a reduction of the purchase price in proportion to the non-conformity; or withdraw from the contract of sale and request a refund of the amount paid.

Restoring the conformity of the goods free of charge

The consumer may request that Larso, s.p. bring the goods into conformity free of charge, without significant inconvenience to the consumer, within a reasonable period of time, not exceeding 30 days, from the time he notifies Larso, s.p. of the non-conformity of the goods, taking into account, in particular, the nature of the goods and the purpose for which the consumer needs the goods. The time limit may be extended to the minimum time necessary to complete the repair or replacement, but by no more than 15 days. In determining the extended period, account shall be taken of the nature and complexity of the goods, the nature and seriousness of the lack of conformity and the effort required to complete the repair or replacement. Larso, s.p. shall inform the consumer of the number of days for the extension of the time limit and the reasons for the extension before the expiry of the 30-day time limit.

Replacements

In order to restore the conformity of the goods, we allow the customer to choose between repairing the goods or replacing them with new goods. Replacement is possible by sending the products to our address.

The consumer may exercise his rights under warranty claims if he notifies the seller of the defect within the statutory time limit. The consumer must describe the defect in detail in the notification of the defect and give the seller the opportunity to inspect the item.

The seller shall be liable for the non-conformity of the goods in accordance with the provisions of civil law. Consumers are subject to the provisions of consumer protection law, even if they deviate from the rules set out below. The seller shall not be liable for any lack of conformity of the goods which becomes apparent after two years have elapsed from the date of purchase.

Withdrawal from the contract for lack of conformity

If the consumer withdraws from the contract due to non-conformity of the goods, Larso, s.p. will refund the payment as soon as possible, but at the latest within 8 days after receipt of the goods or proof that the consumer has sent the goods back. The company shall return the payments received to the consumer to the card used to pay for the online purchase or to the chosen TRR.

Privacy and data protection policy

Larso, s.p. is committed to the permanent protection of all personal data. All data obtained through the website www.postanipartizan.com will be used exclusively for sending information material, offers, invoices and other necessary communications. The user’s data will not be disclosed to any third party, except in the case of a written request from a government institution.

The delivery details are the same as the payment details.

Larso, s.p. is not liable for the consequences of the use of products purchased through the Postani Partisan online shop, which arise from use that is not in accordance with the instructions for use of these products. Larso,s.p. is not liable for any disruptions in the operation of the service caused by the user’s behaviour (e.g. computer infected with viruses) or by the providers of the routes or infrastructure used by the Postani Partisan online shop service (e.g. failure of the interconnection network).

Larso, s.p. complies with the applicable legislation and takes care of users and customers at all times. In the event of any disputes, Larso shall use its best endeavours to reach an amicable solution. Any complaint can be addressed to the published contacts.

Larso, s.p. makes every effort to provide at all times appropriate product images, descriptions and instructions. However, the photographs of the products in the online shop Postani Partzan are symbolic and the available textual materials are for informational purposes only. Before use, the buyer or user must read and follow the instructions supplied with the product.

Users may bring any errors to our attention at any time, for which we at the Postani Partisan online shop would be most grateful.

Complaints and disputes and application of the law

The Provider complies with the applicable consumer protection legislation. It shall make every effort to comply with its obligation to set up an effective complaint handling system and to designate a person whom the customer can contact by e-mail in the event of problems. The user (buyer) can send a complaint to [email protected]. The complaint handling process is confidential.

The Provider will acknowledge receipt of the complaint within five working days and will inform the User (Customer) of how long it will take to process the complaint and keep the User (Customer) informed of the progress of the complaint. The Provider will use its best endeavours to resolve any disputes amicably. If no amicable settlement is reached, the Ljubljana court of competent jurisdiction shall have exclusive jurisdiction to resolve any disputes between the Provider and the User (Purchaser). The Provider and the User (Purchaser), as participants in electronic commerce, mutually acknowledge the validity of electronic messages in court.

These General Terms and Conditions of Business and all disputes between the Provider and the User (Buyer) shall be governed by and governed by Slovenian substantive and procedural law, without any rules of private international law referring to the application of any other law.

The provisions of the Code of Obligations, the Electronic Commerce Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not governed by these General Terms and Conditions.

Out-of-court settlement of consumer disputes: In accordance with the legal norms, we do not recognise any provider of out-of-court settlement of consumer disputes as competent for the settlement of a consumer dispute that a consumer may bring under the Act on Out-of-Court Settlement of Consumer Disputes.

The above-mentioned regime is based on the Act on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.

Amendments to the General Terms and Conditions

The Provider may amend and/or supplement these General Terms and Conditions in the event of changes to the regulations governing the operation of online shops, data protection and other areas relating to the operation of the Provider’s online shop, and in the event of changes to its own business policy, and will inform the Users of these General Terms and Conditions in an appropriate manner, in particular through the www.postanipartizan.com website, in each case. Any amendments and/or additions to the General Terms and Conditions of Business shall enter into force and shall be applicable upon the expiry of a period of eight days from the date of publication of the amendments and/or additions. If a change and/or amendment to the General Terms and Conditions is necessary to comply with the regulations, these changes and/or amendments may exceptionally enter into force and application within a shorter period of time.
